All content on the ErecteMax website, including but not limited to text, images, graphics, logos, product names, and design, is the property of ErecteMax or its licensors. This content is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or use any content from this website without our express written permission. Unauthorized use of our intellectual property may result in legal action.

By purchasing ErecteMax, you agree to indemnify, defend, and hold harmless ErecteMax and its parent company, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees from any claim or demand. This includes reasonable attorneys’ fees arising from your breach of these terms or violation of any law.

ErecteMax shall not be held liable for any direct, indirect, incidental, or consequential damages arising from the use or misuse of our products. Results may vary from person to person, and individual experience is not guaranteed.

This website and every ErecteMax product sold through it are intended exclusively for adults aged 18 years or older. By placing an order or opening an account you confirm that you are at least 18 and legally capable of entering into a binding contract.

We may refuse or cancel any order where we have reason to believe the purchaser is under 18, and we may ask for proof of age before we ship. ErecteMax must not be resold to, supplied to, or used by a minor.

Product listings on this website are an invitation to buy, not a binding offer by us. Your order is an offer to purchase. The automatic confirmation email we send acknowledges that we have received your order; it does not by itself create a contract.

A contract is formed only when we send a dispatch or shipping confirmation for the items concerned, or when we accept your order in writing. Where an order covers several items, the contract covers only the items we confirm as dispatched.

Before acceptance we may decline or cancel an order, for example where stock is unavailable, where a price or product description is clearly wrong, where a payment or fraud check fails, where the order appears to be for resale or in unusual bulk, where we do not ship to the delivery destination, or where we cannot satisfy ourselves that the purchaser is 18 or older. If we cancel after you have paid, we refund the full amount charged to the original payment method.

Prices are displayed in Canadian dollars (CAD) unless another currency is expressly shown at checkout. We may change prices at any time, but a change never affects an order we have already accepted.

Unless stated otherwise, displayed prices exclude sales taxes. Any GST, HST or QST applicable to your delivery address and to our registration status is calculated and shown at checkout before you confirm payment. Shipping charges are shown separately; shipping is free on orders over $75 within Canada.

Obvious pricing errors are not binding on us. Where a price is clearly incorrect we will contact you before shipping and offer you the choice of confirming at the correct price or cancelling for a full refund. International orders may attract customs duties, import taxes and brokerage fees charged by the destination country. Those amounts are payable by the recipient and are not included in the price paid to us.

We ship discreetly across Canada and to many international destinations. Orders are normally processed within 1 to 2 business days after payment clears. Business days exclude weekends and Canadian statutory holidays.

Indicative delivery windows after dispatch are 2 to 8 business days within Canada and 7 to 21 business days for international destinations. These windows are estimates rather than guarantees, because transit time depends on the carrier, the destination and customs clearance. If a window is materially exceeded, contact us and we will trace the shipment with the carrier.

You are responsible for the accuracy of the delivery address you give us. Parcels returned to us as undeliverable because the address was wrong or incomplete may be reshipped at your cost. Please report any parcel that arrives damaged, opened or incomplete within 7 days of delivery so that we can resolve it with you and the carrier.

You may use this website only for lawful purposes and for your own personal, non-commercial purchasing. You agree not to resell or commercially redistribute ErecteMax products without our written authorisation.

You must not attempt to gain unauthorised access to any part of the site, its servers or any connected system; probe, scan or test its security; interfere with its normal operation; introduce malicious code; scrape or harvest data, including other people’s personal information; place fraudulent or speculative orders; impersonate another person; or submit content that is unlawful, defamatory, harassing, misleading or infringing.

You are responsible for keeping your account credentials confidential and for activity carried out under your account. Where we reasonably believe these rules have been broken we may suspend or close account access, cancel affected orders and take any further step available to us in law.

These Terms, and any dispute arising out of them or out of a purchase from ErecteMax, are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in that province, and the courts of Ontario have jurisdiction, subject to the paragraph below.

This clause does not deprive you of the protection of the mandatory consumer protection rules of the place where you habitually reside. In particular, the Consumer Protection Act of Quebec is legislation of public order: a consumer resident in Quebec keeps every right and remedy that Act confers and may bring proceedings in the judicial district where they reside, whatever this clause says about another province.

Nothing in these Terms limits any right that cannot be waived under applicable consumer protection law. If part of this clause is held unenforceable, the remainder continues to apply.
